The OTC Compliance Checklist for Private-Label Hearing Aid Brands

Whether a device can legally be sold as an OTC hearing aid in the US is decided by hard numbers — output ceilings, insertion depth, user controls — plus what your box and your listing say. Get any of them wrong and you are not selling an OTC hearing aid; you are selling a prescription device without a prescription. This guide walks the requirements a distributor or private-label brand has to verify before ordering.

Most buyers treat compliance as paperwork that happens after the product decision. In the OTC hearing aid category it works the other way round: the regulation constrains the hardware itself, so a platform that fails one of the technical limits can never be sold as an OTC hearing aid, no matter how good your listing is. That makes compliance a sourcing question — one you settle before you place an order, not after.

This guide walks through what the FDA’s OTC rule (21 CFR 800.30) actually requires: the hard numbers your platform must meet, what has to appear on the box, what your marketing may not say, and the questions worth putting to a factory before you commit. Every requirement below links to a source you can check yourself.

First: who the category is for

The OTC category, effective 17 October 2022, covers air-conduction hearing aids for adults 18 and older with perceived mild to moderate hearing impairment. Two consequences follow immediately, and both are commercial as much as legal: you cannot market to under-18s, and you cannot position the device for severe or profound loss. A device sold into the wrong audience generates returns and complaints even before a regulator gets involved.

Note the word "perceived." OTC works on self-assessed difficulty — no audiogram, no professional fitting. That is what makes the category possible, and also why your onboarding material carries more weight than in prescription channels: nobody else is there to catch a mismatch.

The hard technical limits

These are decided at the platform level, by whoever designed and built the device. They are not adjustable by you after the fact, which is exactly why they belong in your sourcing checklist.

The practical reading for a buyer: a high-power platform is not automatically the better buy. If a device can exceed the ceiling, it is not eligible for the OTC channel — the same specification that looks impressive on a datasheet can disqualify the product from the market you intended to sell into.

What has to be on the box

Packaging and user materials are regulated content, not marketing space. The outside package must carry, among other things:

  • The marks "OTC" and "hearing aid", displayed as prominently as the statement of identity of the device.
  • A warning against use by anyone under 18.
  • A description of the symptoms of perceived mild to moderate hearing loss, so a buyer can judge whether the device suits them.
  • A statement that professional services are available — and the "red-flag" conditions that should send someone to a physician rather than a shelf. (The rule requires them; take the exact wording from current FDA guidance rather than copying a competitor’s box.)
  • Battery type and quantity, and whether batteries are included.
  • Manufacturer contact information and the return policy.
  • If the unit is used or rebuilt, that fact must be declared — a sticker visible through the outer wrapper is acceptable.

Selling an OTC hearing aid without the required statement of OTC availability on the label is prohibited outright. This is one of the cheapest possible compliance failures — the artwork costs nothing extra to get right, and it invalidates the whole shipment if you get it wrong.

What your listing must not say

This is where private-label brands get into trouble fastest, because the copy is written by marketers rather than regulatory staff. The pattern to internalise: describe what the device does, never what it cures, and never imply government endorsement.

The first row deserves emphasis because it is the single most common error in this category. An establishment registration is not an approval. Registering a facility with the FDA is an administrative fact about the manufacturer; it is not a review of your product, and presenting it as endorsement misrepresents the agency. Most preset OTC devices are 510(k)-exempt, which means no premarket review took place at all — there is nothing there to call an approval. State the registration as the neutral fact it is.

What pushes a device out of the OTC category

A hearing aid is a prescription device — not an OTC one — if any of the following is true:

  • It requires implantation or surgical intervention.
  • It does not let a lay user control and customise it themselves.
  • It fails any of the labeling, output, electroacoustic or design requirements of the rule.
  • Its labeling lacks the required statement of OTC availability.

Worth noting alongside this: self-fitting OTC devices need their own FDA 510(k) clearance supported by clinical data, while preset OTC devices are 510(k)-exempt. Both are legitimate OTC routes — they simply carry very different regulatory workloads, which we covered in our self-fitting vs preset guide.

Questions to put to your factory before you order

Compliance failures are far cheaper to catch at the quotation stage than at customs. Ask for these in writing:

  • What is the maximum output (dB SPL) of this platform, and is input-controlled compression active? Ask for the measurement, not a marketing adjective.
  • How does the design limit insertion depth, and what evidence supports the 10 mm expectation?
  • Is there a user-adjustable volume control, and what can the end user change without professional help?
  • Is this platform positioned as preset or self-fitting — and if self-fitting, where is the 510(k) clearance?
  • Can you supply compliant packaging artwork and user materials, or is that on us?
  • What is the establishment registration number, and can we verify it in the FDA database?
  • Will you provide test reports and datasheets in English for our import file?

A supplier who can answer these quickly and in writing is telling you something useful about how they run production. A supplier who answers with reassurance instead of numbers is telling you something too.

Where sourcing fits in

Output ceiling, insertion geometry, user controls, and whether compliant artwork exists at all — every item on this list is settled at the factory, before your brand goes anywhere near the box. That is the honest reason to treat compliance as a sourcing decision rather than a launch task.
